The Village of Evendale
Regular Council Meeting
November 8, 2007


The Village of Evendale held its Regular Council Meeting. The meeting was called to order by Mayor Don Apking. Upon roll call, the following council members were present: Mrs. Carolyn Smiley-Robertson, Mr. Stiney Vonderhaar, Mr. Bill Puthoff, Jr., Mr. Doug Lohmeier, Mr. Jeff Albrinck and Mr. Chris Schaefer. Also present were: Village Engineer, James Jeffers; Assistant to the Mayor, Jack Cameron; Village Solicitor, Tim Burke; Economic Director, Linda Fitzgerald and Village Clerk, Michelle Ficke.

Mayor Apking presented the consent calendar. Mayor Apking asked for a motion to accept the consent calendar consisting of the Regular Council Meeting Minutes from October 11, 2007 and Special Council Meeting Minutes from October 17, 2007; CFO Report for October, 2007; Tax Administrator’s Report for October, 2007; current Departmental Reports. Treasurer’s Report for October, 2007. A motion to accept the consent calendar as amended was made by Mr. Vonderhaar, seconded by Mr. Lohmeier and unanimously approved.

Reports of Mayor and Council Committees

Doug Lohmeier gave the Recreation Commission Report. He did not attend this month’s meeting. They discussed the budget.

There was no Finance Report.

Mr. Schaefer said that his committee discussed year end issues all of which are included in their committee minutes. They also discussed the Cooper Creek project.

Mayor’s Report.  Mayor Apking congratulated John Ranz who was present and will be serving on council beginning December 1. The organizational Council Meeting, as required by the Charter, will take place on Saturday, December 1, at 8:00 pm. Council Committee Meetings will take place on Tuesday, December 4th and the Regular Council Meeting was changed from Thursday, December 13 to Monday, December 10th due to Mayor Apking’s scheduled surgery. There will be a Public Hearing on the 2008 Budget at 7:00 on December 10 prior to the Council meeting.

Mayor Apking presented Ordinance #07-64, ORDINANCE AUTHORIZING MAYOR TO HIRE A PART-TIME EMPLOYEE AND SETTING A PAY RATE AND DECLARING AN EMERGENCY. A motion to read Ordinance #07-64 by title only was made by Mr. Vonderhaar, seconded by Mrs. Smiley-Robertson and unanimously approved on roll call. A motion to suspend the second and third readings of the ordinance was made by Mr. Albrinck, seconded by Mr. Lohmeier and unanimously approved on roll call. A motion to adopt Ordinance #07-64 as an emergency was made by Mr. Lohmeier seconded by Mr. Vonderhaar and unanimously approved on roll call. Mayor Apking declared Ordinance #07-64 adopted as an emergency.

Mayor Apking presented Ordinance #07-65, APPROVING ADDITIONAL APPROPRIATIONS IN VARIOUS FUNDS, TRANSFERRING FUNDS AND DECLARING AN EMERGENCY.
A motion to read Ordinance #07-65 by title only was made by Mr. Lohmeier, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to suspend the second and third readings of the ordinance was made by Mr. Vonderhaar, seconded by Mr. Lohmeier and unanimously approved on roll call. A motion to adopt Ordinance #07-65 as an emergency was made by Mr. Albrinck seconded by Mr. Vonderhaar and unanimously approved on roll call. Mayor Apking declared Ordinance #07-65 adopted as an emergency.

Mayor Apking presented Ordinance #07-66,        ORDINANCE AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT BETWEEN THE VILLAGE OF EVENDALE AND THE EVENDALE COMMUNITY IMPROVEMENT CORPORATION REGARDING THE PROPERTY AT THE SOUTHEAST CORNER OF GLENDALE-MILFORD AND READING ROADS AND DECLARING AN EMERGENCY. A motion to read Ordinance #07-66 by title only was made by Mr. Albrinck, seconded by Mrs. Smiley-Robertson and unanimously approved on roll call. A motion to suspend the second and third readings of the ordinance was made by Mr. Vonderhaar, seconded by Mr. Lohmeier and unanimously approved on roll call. A motion to adopt Ordinance #07-66 as an emergency was made by Mr. Puthoff seconded by Mr. Albrinck and unanimously approved on roll call. Mayor Apking declared Ordinance #07-66 adopted as an emergency.

Mayor Apking presented Ordinance #07-67, ORDINANCE AUTHORIZING MAYOR TO ENTER INTO CONTRACT WITH THE LOWEST AND BEST BIDDER FOR THE COOPER CREEK REHABILITATION PHASE I PROJECT AND DECLARING AN EMERGENCY.  Mr. Lohmeier asked what the original estimate was for the project. Mr. James Jeffers explained that the engineer’s estimate was $150,000. The cost went up as a result of using union workers. The cost of the project is deferred until next year. Mr. Schaefer clarified that $75,000 was allocated for 2007 and another $75,000 for 2008. The amount for the project is the combined 2007-08 monies. We have enough money to do this project and have a year end unencumbered balance near $13M dollars.

A motion to read Ordinance #07-67 by title only was made by Mrs. Smiley-Robertson, seconded by Mr. Albrinck and unanimously approved on roll call. A motion to suspend the second and third readings of the ordinance was made by Mr. Albrinck, seconded by Mr. Lohmeier and unanimously approved on roll call. A motion to adopt Ordinance #07-67 as an emergency was made by Mr. Albrinck seconded by Mr. Vonderhaar and unanimously approved on roll call. Mayor Apking declared Ordinance #07-67 adopted as an emergency.

Mayor Apking presented Ordinance #07-68, ORDINANCE AUTHORIZING MAYOR TO ENTER INTO CONTRACT WITH THE LOWEST AND BEST BIDDER FOR THE READING ROAD PATH AND ISLAND LIGHTING PROJECT AND DECLARING AN EMERGENCY. James Jeffers said that this ordinance includes the Island lights on Reading Road and the Reading Road path lighting only but does not include the lights on the municipal grounds. There are 84 fixtures on Reading Road path and approximately 20 island lights. Mayor Apking said that reflectors will be put on the path lights to reflect light out toward Reading Road and away from businesses. Mr. Lohmeier asked about the flower pots in the islands on Reading Road. Mr. Jeffers explained that the pots they received after the traffic accident that damaged them were not molded effectively. The fiberglass compressed when filled instead of holding its form. The pots were paid for by the insurance of the person driving the car that damaged them and are being replaced. Mr. Puthoff asked if the lighting for the grounds is in the budget for 2008 and suggested that this be incorporated into the 2008 budget.

Mayor Apking said that Duke is not maintaining the lighting in some of the neighborhoods in the Village. We plan to maintain them in house and will install new lighting as well. Mr. Lohmeier said we should look closely and compare the costs to see if this is a wise decision.

Other items:

Mr. Vonderhaar said that on November 11 at 1:00 pm there will be a Veterans Day Remembrance Day Ceremony at Rest Haven Memorial Park at the Cunningham Gravesite. The Town Meeting will be held on November 11 at 5:00 pm. Sign up at the Recreation Center.

November 14 is the 50th anniversary of Mike Albert and a celebration will take place at Mike Albert at 6:30 pm.

December 2 at 5:00 is the Holiday Light Up at the Recreation Center. Sign up at the Rec.
The Evendale Chamber of Commerce Holiday dinner is at St. Rita’s on December 5 at 5:30.

A motion to adjourn was made by Mr. Schaefer, seconded by Mr. Vonderhaar and unanimously approved. Council adjourned at 7:31 pm.
